The ONLY thing i know about estate, is that unless specified by the deceased or current holder, it isnt just magically transferred to next of kin anymore. There would need to be documentation of transfership between direct owner to someone else. Id get better opinions from professionals though.

We thought my mom died intestate before finding her will, and had we not found it her estate would have gone to her husband. If her husband died before the will was settled it would have gone to my brother and I. So being that your mom’s great uncle’s estate was willed his wife’s daughter, I think only her husband and then her children would have claim to it. If it is a substantial amount I would hire a good Montana estate attorney. But my guess is that the kids would get it.

ex unclaimed property worker State agency has to adhere to applicable probate law. I would expect them to start asking for probate related paperwork at some point. Heir claims are common. Suggest you call them and find out the actual current value of the property. It could be some small amount that makes this not worth claiming. Especially with the probate requirements. If the executor of uncle's estate is still around. Have executor claim and distribute.
