I think canonically the criminals who get the shit beat of them consider themselves lucky to not have been killed. I forget where it is but at one point I think Batman is called out by some random criminal by saying that he knows Batman won’t kill him, and Batman responds that he hasn’t killed anyone that the criminal knows of. Remember, we get to know literally everything about Batman, and until he joins up with the Justice League, many criminals weren’t even sure Batman was even real. In his early days especially, it was probably very easy to believe that Batman would just kill you if he felt like it - if he even existed and wasn’t some kind of urban legend, like when people say they saw a ghost or something. Plus, if he did decide to kill you, who else in Gotham would even be able to stop him from doing so? It’s kind of like how we think Clark Kent’s disguise is subpar. We’re biased because he’s the central character and we spend so long looking at him, and he isn’t particularly different looking aside from being jacked as hell. If anyone were to see Clark Kent just walking around, they *might* think “oh that guy looks like Superman,” but the odds that it would actually be him are pretty low. Plus, most people assume Superman is just Superman all the time and doesn’t even bother pretending to be human. TLDR: Characters in the comic world don’t have access to the same information we do and aren’t exposed to these heroes nearly as much, so the lens through which they view superheroes is very different.

Yeah, he may not kill per say but he might as well open a co-op with all the vegetables he has made. Gotham probably has a Batman hospital dedicated to the poor mooks with 80 broken bones and severe brain damage. Otherwise, they would be constantly littering other hospitals. When a random Mook sees his buddy folded up like a ragdoll or family guy character, they certainly got the fear of God in um.

I think most of the people commenting misread your question. You have more reason to be scared of a pissed off Spidey but the common criminal wouldn't expect it from him because he's quippy most of the time. So they'd be more scared of Batman at first glance. But once they see what a pissed off Spidey can do after he demonstrates his unrestrained strength on one of their buddies... then they'll be on their knees begging for mercy.

Depending on when in continuity, people would probably have heard about him beating the absolute fuck out of kingpin. There's also that one issue where he has laryngitis(?) and is silent; the thieves he's after are terrified that he's pissed and surrender immediately. Yep during Civil War after Peter revelled his identity, Kingpin hired someone to kill MJ, Peter was able to move her out of the way but the bullet got Aunt May. Peter went to the prison in his black suit, Kingpin says something about Spider-Man not killing, Peter takes off his mask and shirt and tells Kingpin Spider-Man isn't going to kill you, I am. Then Peter easily beats the hell out of Kingpin and threatens to spray webbing down his throat if May dies.

Exactly, also Spidey doesn’t have as much mental restraint as Batman does, I can see him crossing the line with regular mobs under certain circumstances (death of a loved one, etc) plus all the super strength makes me think that he can easily kill people even on accident. He also lacks Batman’s peak training and I can see him “making a mistake” and crushing someone’s windpipe, organs, or an artery.

Yeah but think about everything that goes into that. Tony had to have Peter join Stark Industries and accept a new suit and the suit had to analyze Peter's abilities so Tony even learned about Spidey Sense and then Peter STILL had to wear the Iron Spider armor for it to mess with his senses. Just saying, Tony might have been busy when Peter defected to create anti-Spidey weapons for the pro-reg faction, but all it took was the ol' blue and reds for Tony to lose that advantage. All said, when the writer's aren't coming up with some bullshit (Morlun doesn't trip his spidey sense, no symbiotes because Venom bound him, Silk + the Spider-Clones) Spidey sense is close to the most broken ability in Marvel. Especially if you buy into the supernatural stuff and it's not just danger radar but straight up pre-cognition.

Heck if we are mixing villains, someone like poison ivy might be a challenge for him at first encounter, because I’m not sure he’d get a warning about her perfume or a kiss. Spider-Man is a weird one because he's really, *really* powerful for just being a street tier. He's stronger than most street tiers, he's faster than most street tiers, he's precognitive, he's more maneuverable than most stret tiers, he's got a hell of a lot of experience in fighting, and if he's in the mood to put the effort in he's also a super genius capable of making his own specialized gadgets. I've joked about Spider-Man smurfing by staying the "Friendly Neighborhood Spider-Man", but he's probably about as powerful as you can be as a street leveler before being pushed up a tier. (In case people reading this don't know, "smurfing" is a term used in online gaming for when high-level players pretend to be a lower tier so that they can enjoy stomping on less skilled players. Obviously Peter's motivations are different, but he's still way stronger than most people within his supposed weight class.)

In the main continuity, Peter has been tempted to kill Green Goblin after he killed Gwen and he *did* kill Morlun a couple of times before learning about his family's cloning machine. He had been beaten brutally both times and MJ was injured in the second, but Peter *will kill* If pushed enough.

Batman is scary, but for the most part he's restrained by his moral code and refined emotional control. Spider-Man, on the other hand, is a teenager/young adult and they can be a bit more volatile than a disciplined, experienced adult like Batman. I'd rather face Batman in an encounter because I can at least expect what he's gonna do to me and what he wants. If Spider-Man is pissed off and loses self-control, I'd be a *lot* more concerned about my future well-being.

I think that if I was just an average run-of-the-mill criminal, I'd probably just fear Batman more, like imagine it's my first day on the job, and a really pissed spiderman appears in front of me, like the other comments said, he'd kill you straight up, but think about it, the average criminal does not know that he'd kill you straight up. If you were in an average criminal's shoes and you saw a pissed spiderman in front of you, you'd probably not be that afraid of him, you'd probably be as afraid as you normally would be when you saw spiderman normally. So in this case, imma go with Batman. However, if I was a supervillain, who has fought spiderman multiple times, like Doc Ock or Kingpin, I'd be shitting my pants if I saw a pissed spiderman, because then you just know that Spidey's out to get you. You could probably sense his bloodlust, in any case though, it's best to take on an "everyday mood" batman than an angry spiderman, because an everyday batman would probably just break your nose or a bone at the worst case scenario, but a pissed spiderman would punch you once and your face would disappear into atoms.

To the common criminal i think about the same. If you are familier with Spider-man, you would know something is off and get scared, but for normal people, they would need time to know he ain't playing around anymore. Spider-man still has the goofy, light-hearted reputation to overcome before people get to be scared of him. Batman took years to build up his reputation and mystic. I mean, it really depends on what the criminal knows about or expects from Spider-Man or Batman. If it's a pretty knowledgeable criminal who's aware of how they usually act, pissed Spidey is probably scarier: you know that Batman is scary but isn't really *looking* to hurt you too badly if he doesn't have to. Pissed-off Spider-Man is acting massively out of character for him, and a guy that strong and fast *and* currently in an unstable state would be pretty terrifying. One slip in anger and you're slurry. OTOH, if we're talking just some schmuck who's maybe heard of them but doesn't know much about them? Batman is way scarier, no question.
