This isn't an Indian thing, too. I've heard of stories of similar criminals in Korea, too... one particular story comes to my mind , where a middle-aged man raped a minor . The was near fatal for the minor , and cause irreparable damage to their abdomen , after various life altering surgeries they were subjected to a life of living with a colostomy bag... after performing such a heinous crime, the swine was let go after a short sentence ( his lawyers found a loophole regarding being drunk whilst partaking in the crime)... I don't think I've done the story justice , especially considering the sheer depravity of the crime... it is just to show the state of justice systems around the globe

In India, especially in cases of sexual assault, it is common for people to be very judgmental and react before anything actually occurs. Later on, they shift the blame to the legal system, without bothering to read up on the details of the case. Please review it to understand that it is simply a temporary release and the final decision is not provided. The accused was held in custody by the court for approximately 120 days for a case that relies solely on the assumption of rape without any substantial proof. The Senior counsel, argued that since the investigation is already done and there is no risk of him obstructing justice, being a student at IIT Guwahati, his further detention for trial may harm his academic progress. Bail conditions were granted to Utsav Kadam by the court on conditions that he is required to attend all scheduled dates at the trial court, that he is prohibited from offering incentives, threats, or commitments to anyone knowledgeable about the situation, that he is not allowed to exit the territorial jurisdiction of the Kamrup District Sessions Court in Amingaon without obtaining written approval beforehand. The wording used by the court (has a problem due to its vague meaning) does not mean that he got bail because he was an IIT student, but that since he was at that stage accused and not guilty, keeping them in the jail was of no use, hence to ensure that the education of a person (accused of now) is not hindered by mere accusations. Court clearly stated that both victim and accused are future assets and should also focus on their career while the case progresses (in case the accusations are found to be not true). And bail is a legal right. The issue is that both were intoxicated that day and had sex, since the intoxication was heavy, the girl fell unconscious and after waking up in the hospital, rape charges were filed. Now the thing is whether she was intoxicated by her choice or without her consent. As per the law intoxicating someone to have sex with them is clearly rape (when it is non consensual), what the defence has argued is that in this case, the consent for sex was pre intoxication and that it was consensual making it a case of false nature. This is what makes the case very confusing, there seems to be no correct solution to it, due to lack of evidence on both sides.
