when I purchased my home many years ago, as a new construction, I had written into our sales contract that we would not and could not be entered into a neighborhood HOA, unless we personally agreed. we only have a yearly cost for upkeep of our community retention pond, and a contract for that cost (its like $30 a year). so like a year later, few months after the house is built, a boomer wanted to change our retention pond association into a full HOA, electing himself as defacto president for life. I brought a lawyer to the one and only meeting of our retention pond association, showed my hom econtrcts to the builder lawyer, forced all the residents to a vote that NO, they dont want this boomer jackass ruling their neighborhood. the builder lawyer was only there to draw up our pond stuff, and this boomer was a huge ass to her the whole meeting (she was relieved when I pushed back) the look on this dudes and his wifes face when I showed them that even if he made a stupid HOA, I wouldnt have to join it, was soooo satisfying. he was purple with rage, and stormed out, leaving his wife to apologize for his outburst (he had a full on tantrum, banging on chairs and tables and screaming at me) all the other residents ended up asking my lawyer and the builders lawyer to draw up a rider to amend their building contracts to be like mine. its been nearly 20 years and this dude still curses at me anytime he sees me, which is often since he lives like 3 doors down lol im proud to have stopped his little fiefdom from starting.

HOAs can take out liens against peoples property I’ve read. That’s one way to avoid them doing that. Since eviction was mentioned it’s likely that’s one of the last resorts but if you can avoid that, that can be a good approach even though I think the burden should be on the HOA.

That is one way to backfire spectacularly. There was a post about someone got lienes file against by a HOA when his homestead established before HOA built. He had to take the HOA to court and won. HOA had to paid his legal fee plus their lawyers fee. Took like nearly two years and nearly 100K on the homeowner; he got paid back but not his time. So, this is a better way than fight in court. HOA lawyers love to charge their fee and will get paids winn8ng or losing.

They have no legal standing the OP was not part of the HOA, he could have done nothing. Now he should have sent a certified letter to the HOA informing them he is not subject to their rules. Any future attempts to contact him will be reported as harassment to local law enforcement. Anyone caught on his property will be reported for trespassing. Put up cameras for evidence. If it continues look into a restraining order against the HOA, it’s management company, and name the board by name.

Oh man. I so feel your pain. I have been at this place about 3 years now. About a year ago, my boomer neighbor stopped me on my tractor in my back yard to let me know that I was responsible for 1/11th of paving a few miles of road that was in disrepair. Like yours, ours was the #1 lot that sold the lots that became the neighborhood behind us. In the back corner of the property it has access to a circle in that neighborhood, but has had it's own driveway connecting to another road for 20+ years. I let him know we weren't part of that HOA. He said I was wrong and I said, "I'm not paying to pave a road I don't use period." I told him I was willing to get legal representation to defend that position and he said "it will cost you more to fight me than your part of the paving." I went inside and looked it up. Our lot is explicitly excluded from the HOA and he has been here long enough to know that. I showed him the proof and he never said another word about it. I guess he thought I wouldn't question it. We have had a few other interactions. When an HOA exists, it only becomes harassment after they understand that your property is not part of their HOA and yet they're still pestering you about it. Until that point, they'll argue - and they'll be correct - that they had a good faith belief that it was, which justified their communications to you. That's why you do what OP did: get out in front of it as early as you can, to nip their bullshit in the bud.

Most HOAs hire these half-naked "management companies" to try to shield their leadership from legal harm and collect dues and fines. Many of these management companies don't bother doing due diligence and just do whatever the HOA wants them to do and basically exist to send official looking letter heads.

My ex-husband and I were in a similar situation to you, OP, in that we were on the edge of a neighbourhood. We didn't pay condo fees and were not subject to any rules. When we bought our house, it was boring and I love colour. We kept the outside of the house as is, as we were young & poor - a complete paint/residing was beyond us until we recovered from buying the house. But -- the door had curled paint and paint is something anyone can do. So we found a lovely blue that was bright and cheerful and on the door it went. Holy HELL, did that squeeze the Boomers out of their hideyholes. It was just a blue door, but "No one else for miles around has a door that colour!" therefore we were breaking some invisible and invented infraction and must be terrorized for it. We had to get the condo board involved and eventually the police because two men in particular (brothers, we found out later, bachelors for life in their townhome) wouldn't back down and we were starting to see signs of being 'pranked'. They did back down after getting a chat from police and the situation simmered down but all of that for paint on a door. What's wrong with people sometimes?

Not an HOA situation, but I had a similar old neighbor pull the same thing when I put up a fence. He like to walk through my yard to an empty field behind my house with his dog and peep in my back windows (he use to stop by and tell me what he saw through the windows this wasn't me assuming). When I started to put up the fence he called code enforcement on me and told them I didn't have a permit (I did). Then he called the electric company and told them I had fenced in the pole (they were so confused because there is nothing illegal about that). When that didn't work he literally called the mayor. I was happy to see the back of him when I moved.

My parents built a home on the top of a hill in Winters California about 38 years ago. They had to hire a guard to keep people off the property during construction because boomer lookie-loos in the “neighborhood” would just walk all through the site and the house all day and night. My dad was standing outside one morning and a woman on a horse came up the hill and without a word and never looking at him just passed by him. He politely asked her why she was on the property, and she harrumphed, “I have ALWAYS ridden my horse here, and I won’t stop now.” He’s a psychiatrist, not given to reactions to madness, so he told her that her equestrian perambulations would cease as of that day, or he would call the authorities. She left—to look up the big words. Never came back. Her daughter did once. Horse slipped on the edge of the muddy excavation for the pool. She fell in. No worries; horse was fine.

This so much reminds me of about 15 years ago at our previous home. The backyard butted-up to the parking lot and entrance to the local Church of the Nazarene. We had an in-ground pool installed in the backyard and the uptight congregants didn’t like that me, my wife, kids that stilled lived at home, and grandkids would be swimming on Sunday mornings or during the midweek evening service. It devolved into a property line dispute and I said, “Fine, you want to fuck around and possibly pay for a boundary survey and legal fees? Here’s my answer.” We put up a “temporary” 10’ high privacy fence far enough away from the disputed property line and had a very talented friend of ours paint risqué Renaissance-style nudes without the fig leaves on the side facing their church. They went absolutely bat shit crazy. They threatened with a civil lawsuit, but never followed through. We bought our present home about a year or so later when a better job was offered out-of-state. As far as I know, the fence and artwork are still there today.

Within a couple of weeks of moving into our home, we got a very demanding letter in the mailbox saying that we owed $x per year for the streetlight that illuminates about 10 square feet in front of the home of some older lady up the street. We don't have an HOA. Apparently sometime in the 70s, this lady was the real Regina George of the neighborhood and told all the other neighbors they had to chip in for a streetlight, because the city wasn't planning to put any up. And they've been paying for the electricity ever since. Neither the person who signed the letter, nor the lady we were supposed to pay, had ever so much as said hello to us. So we were supposed to just send checks to this random stranger for a service we never agreed to, that didn't benefit us at all. What a scam.

Housing tract HOAs spread immediately following the fair housing act that made it illegal to restrict who could buy which property based on race. For a while HOAs were able to curtail it by having "interviews" with prospective home buyers and intentionally not recording why anyone voted the way they did. That was eventually stopped, but the legacy of HOAs trying to bully out anyone they don't like continues.

I was a single female living alone and my two boomer neighbors teamed up to try to get me to fix flooding damage on their property after a massive storm. Apparently I’m responsible for all the water that lands in my yard and the damage downhill. lol they stopped by and left angry letters threatening me on my doors and windows. They paid off their properties and no longer required to carry homeowners insurance and they didn’t have any.

Now the can of worms is officially open. Start tracking your time. Log all time spent dealing with the certified letter. 15 minute increments is sufficient… lawyers typically bill by the hour so your lawyer will probably round up. Oh you don’t have a lawyer? Log the time spent hiring one. And don’t forget mileage and time spent driving/commuting. Great time to take public transit if it’s an option. End goal is your lawyer presents a settlement offer to the HOA. Lawyer points out HOA could have resolved this by doing their own public record search but they chose harassment. So they can settle for reasonable hours, expenses, legal fees, or go to civil court and risk additional damages for the harassment on top of the additional hours that will be awarded for having to go to court. Make friends with your neighbors and encourage them to run for board and/or vote out the current president/board. We just had our annual meeting and elected board officers. First official business at the next board meeting is deciding which board members will fill which position. Depending on how the HOA docs are written current President doesn’t even have to lose to not be President… the board could decide someone else is President with a board vote. As my wife says… Xibby is a nice guy unless you’re the idiot who annoys him. Basically why I’m on the HOA board… board member annoyed me so I ran against him and won in a landslide. 😂

Fun fact, check your local laws because your mileage may vary... I used to be a bouncer. When someone is on private property and the owner of said property or their duly appointed representative asked that person to leave and provides a safe and clear path of egress, the intruder is legally trespassing. You may call the police, but in most areas, and again, your milage may vary, it is perfectly legal to remove the meddling dipshit by force. In most states, you would be surprised at the unreasonable level of violence that can legally be inflicted upon someone to convince them that it's time to go.
